Information on patent registration in Cyprus

In order to register a patent in Cyprus, same must have been registered in England or in Europe as a European Patent. Such registration is only possible as long as the application is filed within 3 years from the date of the "sealing of the patent" in England or Europe. Also at the time of registration in Cyprus the patent must still be valid in England or Europe.

The applicant through his agent, applies to the Registrar by filing a form for the issuing of a Certificate of Patent Registration. In order to appoint an agent the applicant must sign an power of attorney which is very similar to the one required for trademarks appointing the law office which will undertake to apply for validation of the patent in Cyprus.

With the abovementioned application form the applicant must provide the Registrar with two sets of the patent’s specifications relating to the English or European Registration explaining the specifications of the patent and enclosing the Certificate of Registration in England or Europe.

The rights and privileges conferred by the patent registration remain protected so long as the patent remains in force in England.

The new Patents Law of 1998 is now in force. It provides the conditions under which an invention can be registered as a patent; it provides the persons who have a right to register a patent; the application; the formalities of the examination of the patent; the issue of the Supplementary Protection Certificate for Medicinal Products; infringement rights.
